Patent Infringement Report on Amazon: Case Study

Today we would like to share with you our successful case with the removal of the patent infringement report.
When a client receives a complaint for patent infringement, we, in turn, always provide a patent investigation first. It helps us determine whether our client has infringed the rights of another owner, whether the complainant’s patent covers the client’s product, what the similarities are, and what the differences are. Based on the results, we develop a strategy: 1) prove no infringement + evidence; 2) take the responsibility and ask the complainant/Amazon to remove the infringement.
We have a case where our client received a complaint about two listings. After that, we got a letter from the complainant stating that there would be a trial for our violation of rights. After carrying out the patent research, we found out that the product was similar at first sight, but if you look closer and go deeper into the details of the consultation, they are totally different. Fortunately, the complainant was a clever person and withdrew the complaint, as we explained that her patent does not cover our customer’s product and sent additional evidence in the form of documents.
There was one issue: only 1 complaint out of 2 was withdrawn. The product is the same, but there was a difference in colors. All of our letters were ignored. We contacted Amazon directly but were rejected each time. We removed the violation and explained the whole situation to a third-party service. Amazon reviewed all the documents and our explanations and removed the complaint from the account.
