How To Handle 30 Intellectual Property Violations On Amazon Seller Account: Case Study

A client contacted us with 30 trademark infringements in his account. The listings were active, but Amazon removed the photos on them for allegedly using someone else’s trademark.

In his pictures, the client used a symbol that is protected by another person’s intellectual property rights. First of all, we uploaded new images without a symbol and submitted a Plan of Action. Some complaints were withdrawn, while the rest remained. As we found out later, appeals were accepted randomly because it is impossible to remove all violations at once (looks too perfect for Amazon), so they decided to do so selectively.

Then we sent appeals for secondary review several times, and the violations were removed. We did not send appeals for all 30 violations at once. We decided to take 5-10. Next in the bullet points was one keyword that Amazon identified as a brand name. We checked this with the USPTO, and it turns out that there are no such trademarks. We have 7 violations left. The final stage was a call, at which we explained in detail to the support that this is not a trademark and asked to send it for a second review. After that, after 11 days, all remaining complaints were withdrawn.
